Reaffirming proclamations of Local Emergency and Local Health Emergency and ratification of a Memorandum of Agreement with the California Department of Resources Recycling and Recovery relating to the San Bruno Fire

 

RECOMMENDATION:

Adopt a:

1) Resolution reaffirming the proclamation of a Local Health Emergency under Health and Safety Code Section 101080 and the proclamation of a Local Emergency pursuant to Government Code Sections 8558(c) and 8630(c), and authorizing the County Manager to enter into independent contractor agreements to provide services related to the Local Emergency as deemed necessary, in connection with the City of San Bruno gas line explosion and fire on September 9, 2010.

 

2) Resolution ratifying a Memorandum of Agreement with the California Department of Resources Recycling and Recovery concerning fire debris removal and related environmental restoration activities resulting from an explosion and fire in the County of San Mateo.

 

BACKGROUND:

On September, 9, 2010, a gas line broke causing a fire that killed several persons and injured many others, and destroyed and damaged many homes. The County (Operational Area) Emergency Operations Center (EOC) was activated. On September 14, 2010 this Board ratified the Director of Emergency Services’ September 10, 2010 declaration of local emergency and the County Health Officer’s September 14, 2010 declaration of a local health emergency.

 

DISCUSSION:

The County of San Mateo continues to expend staff time and resources in responding to the destruction caused by the fire. In addition, there are potentially serious health and safety hazards from the fire debris. Accordingly, there is a need to continue both the proclamation of the local emergency and the local health emergency. The first resolution continues both of these proclamations of emergency.

 

Because of potentially serious health and safety hazards from the fire debris that need to be promptly addressed and managed, on September 17, 2010, it was necessary for the County Manager as the Director of Emergency Services to sign a Memorandum of Agreement (MOA) with the California Department of Resources Recycling and Recovery concerning fire debris removal and related environmental restoration activities resulting from an explosion and fire in the County of San Mateo. The second proposed resolution ratifies this agreement.

 

Pursuant to the agreement CalRecycle will execute a Debris Management Plan related to debris removal and related environmental restoration activities, including burned vehicles, structural materials, vegetation, household waste, and trailers. The County will secure permission from affected property owners for CalRecycle contractors to enter their properties. In order to begin debris removal as expeditiously as possible, CalRecycle will utilize funding as available towards the cost of this debris removal program and the County will reimburse all CalRecycle costs for the cleanup. In turn, by a separate agreement, PG&E will advance funds to cover all costs incurred by the County of San Mateo in connection with the removal and disposal of debris resulting from the San Bruno explosion and fire.

 

County Counsel has reviewed and approved the Resolutions and MOA as to form.

 

Approval of this Agreement contributes to the Shared Vision 2025 outcome of a Healthy Community by ensuring the availability of funds in response to this local health emergency and the resulting emerging public health threats to the residents of the County of San Mateo.

 

FISCAL IMPACT:

It is estimated the costs of the debris removal and storage will be approximately $1.5 million which due to reimbursement by PG&E will result in no Net County Cost.
