SUBJECT:

Law Enforcement Services Agreement and Initial Transfer Agreement with the City of San Carlos.

 

RECOMMENDATION:

A.

Adopt a Resolution authorizing the:

1)

President of the Board to execute an Agreement with the City of San Carlos for the provision of transferring personnel, equipment and facilities to the County effective October 31, 2010 as a result transferring law enforcement services from the San Carlos Police Department to the Sheriff’s Office;

2)

President of the Board to execute an Agreement with the City of San Carlos for the provision of law enforcement services provided by the Sheriff’s Office, for a term commencing October 31, 2010 through June 30, 2015, with reimbursement to the County in the amount of $4,460,471.55 for the first year; and

3)

Sheriff or Sheriff’s designee to accept or execute notices, documents and amendments associated with these Agreements under the terms set forth.

B.

Approve an Appropriation Transfer Request (ATR) recognizing unanticipated revenue and establishing a FY 2010-11 appropriation of $4,460,471 in the Sheriff’s Office for expenditures related to the San Carlos law enforcement agreement. (4/5ths vote required)

 

BACKGROUND:

At the December 14, 2009 City of San Carlos Council meeting, the Council discussed and authorized City staff to contact neighboring law enforcement agencies to obtain proposals to provide contract law enforcement services for San Carlos.

On May 10, 2010, the Redwood City Police Department and the Sheriff’s Office both made presentations to the City Council, City staff and the public with regards to the proposed law enforcement services.

On May 24, 2010, San Carlos City Council identified the Sheriff’s Office as the preferred proposal and the Council directed City staff to begin working with the Sheriff’s Office to develop a proposed Law Enforcement Services Agreement and Transfer of City Personnel, Equipment and Facilities Agreement.

On September 2, 2010, the San Carlos City Council held a special meeting to discuss and approve the proposed Law Enforcement Services Agreement and the Initial Transfer Agreement between the City of San Carlos and the Sheriff’s Office. By unanimous vote, both agreements were approved by the City Council.

On September 14, 2010, this Board adopted a salary ordinance amendment which adds 28 positions to the Sheriff’s Office.

 

DISCUSSION:

The purpose of the Transfer Agreement is to facilitate the orderly transfer of assets, programs, costs and personnel from the San Carlos Police Department to the County for the provision of law enforcement services to the citizens and properties within the City of San Carlos. The contract outlines the initial startup of the new law enforcement services model for the City. It also covers all of the specific one-time startup costs associated with not only the labor components of the contract but also addresses the purchase of equipment, facility usage items, technology related issues and all other details necessary to ensure the smooth and successful transition of the City’s law enforcement services and personnel to the County in anticipation of the October 31, 2010 effective date.

The Law Enforcement Services Agreement outlines the services that will be provided to the City by the Sheriff’s Office. Some key service features include: guaranteed 24 hour a day patrol services; maintaining existing response times; restoring full-time traffic enforcement services; City access to increased number of detectives, investigative resources, Reserve Officers, and public safety volunteers for City events; and provide for additional dedicated personnel in the event of a large scale emergency to assist in managing crisis situations. The reimbursement rates will be readjusted by the County annually and become effective July 1 of each year of the nearly five (5) year term and attached as an amendment to the agreement. The first year’s reimbursement by the City to the County is $4,460,471.55.

County Counsel has reviewed and approved the Resolution, Transfer Agreement and Law Enforcement Services Agreement as to form.

Approval of both agreements contributes to the Shared Vision 2025 outcome of a Healthy Community by ensuring the neighborhoods of San Carlos are safe and the transition of law enforcement services from the City to the County are seamless.

 

FISCAL IMPACT:

The Law Enforcement Services Agreement is for a term commencing October 31, 2010 through June 30, 2015. The ATR recognizes revenue and appropriates salary & benefit and operational costs of the contract in the amount of $4,460,471 for FY 2010-11. There is no Net County Cost.
