RESOLUTION REAFFIRMING THE PROCLAMATION OF A LOCAL HEALTH EMERGENCY UNDER HEALTH AND SAFETY CODE SECTION 101080 AND THE PROCLAMATION OF A LOCAL EMERGENCY PURSUANT TO GOVERNMENT CODE SECTIONS 8558(C) AND 8630(C), AND AUTHORIZING THE COUNTY MANAGER TO ENTER INTO INDEPENDENT CONTRACTOR AGREEMENTS TO PROVIDE SERVICES RELATED TO THE LOCAL EMERGENCY AS DEEMED NECESSARY, IN CONNECTION WITH THE CITY OF SAN BRUNO GAS LINE EXPLOSION AND FIRE ON SEPTEMBER 9, 2010

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on September 9, 2010, a gas line exploded in the City of San Bruno, located within the County of San Mateo, causing multiple deaths, injuries and damage to real and personal property; and

 

WHEREAS, the Governor declared a State of Emergency on September 9, 2010 and the Emergency Services Act also requires local jurisdictions to adopt a proclamation in order to be eligible for California Disaster Assistance Act (CDAA) funds; and

 

WHEREAS, for the reasons set forth above, on September 10, 2010, the County Manager, acting as the Director of Emergency Services for the County of San Mateo, declared the existence or threatened existence of a “local emergency" pursuant to San Mateo County Ordinance Code section 2.46.060; and

 

WHEREAS, on September 14, 2010, pursuant to Section 8630 of the Government Code, the Board of Supervisors ratified the proclamation; and

 

WHEREAS, the County of San Mateo is continuing to expend staff time and resources to assist in responding to the damage caused by the explosion and fires; and

 

WHEREAS, certain agreements which normally would be executed by the Board of Supervisors may need to be executed at a time when the Board of Supervisors is not in session and it is in the best interest of the County to authorize the County Manager as Director of Emergency Services to enter into such contracts subject to later ratification by the Board; and

 

WHEREAS, pursuant to Health and Safety Code Section 101080, on September 14, 2010, the County Health Officer proclaimed the existence of a local health emergency which was ratified by the Board of Supervisors on September 14, 2010 and is subject to reaffirmation every 14 days thereafter until such local health emergency is terminated; and

 

WHEREAS, this Board finds that conditions of extreme peril to the safety of persons and property which arose within said County, caused by the fire, warranted and necessitated the proclamations of both a local emergency and local health emergency under Government Code 8558(c) and 8630, Health and Safety Code section 1010180 of and San Mateo County Ordinance Code Section 2.46.060 continue to exist; and

 

NOW THEREFORE, IT IS HEREBY RESOLVED that due to continued conditions of extreme peril to the safety of persons and property that have arisen as a result of the fire and explosion in the City of San Bruno, the Board of Supervisors proclamation of local health emergency pursuant to Health and Safety Code section 101080 and proclamation of local emergency pursuant to Sections 8558(c) and 8630(b) of the Government Code continue to exist within the County.

 

NOW THEREFORE, IT IS HEREBY FURTHER RESOLVED that the County Manager is authorized to engage independent contractors to perform services related to the local emergency as deemed necessary subject to later ratification by the Board of Supervisors.
