RESOLUTION RATIFYING MEMORANDUM OF AGREEMENT

BETWEEN SAN MATEO COUNTY AND CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY CONCERNING FIRE DEBRIS REMOVAL AND RELATED ENVIRONMENTAL RESTORATION ACTIVITIES RESULTING FROM AN EXPLOSION AND FIRE IN THE COUNTY OF SAN MATEO

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on September 10, 2010, the County Manager proclaimed a local emergency due to the natural gas explosion and resulting outbreak of fire causing the destruction of 32 homes and 6 or more damaged severely, and the Board of Supervisors ratified said declaration on September 14, 2010 and continued it on September 28, 2010; and

WHEREAS, on September 10, 2010, the Lieutenant Governor proclaimed a State of Emergency in Executive Order S-14-10 under the California Emergency Services Act and invoked the California Disaster Assistance Act to provide Assistance to the affected County residents; and

WHEREAS, on September 14, 2010, the County Health Officer declared a local health emergency exists as a result of the ash and debris resulting from the fire on September 9th, and the Board of Supervisors ratified said declaration on September 14, 2010; and

WHEREAS, because of potentially serious health and safety hazards from the fire debris that need to be promptly addressed and managed, it was necessary for the County Manager acting as the Director of Emergency Services, on September 17, 2010, to sign a “Memorandum of Agreement Between San Mateo County and California Department of Resources Recycling and Recovery Concerning Fire Debris Removal and Related Environmental Restoration Activities Resulting from an Explosion and Fire in the County Of San Mateo,” and the Board desires to ratify that Memorandum of Understanding;

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Memorandum of Agreement Between San Mateo County and California Department of Resources Recycling and Recovery Concerning Fire Debris Removal and Related Environmental Restoration Activities Resulting from an Explosion and Fire in the County of San Mateo,” executed on September 17, 2010, is ratified.
