RESOLUTION 1) APPROVING A FIVE-YEAR EXTENSION THROUGH OCTOBER 1, 2015 FOR THE FACILITY AND TRAIL CONSTRUCTION TIME PERIOD AS OUTLINED IN THE CRYSTAL SPRINGS TRAIL MEMORANDUM OF UNDERSTANDING BETWEEN THE SAN FRANCISCO PUBLIC UTILITIES COMMISSION AND THE COUNTY OF SAN MATEO; AND 2) AUTHORIZING THE DIRECTOR OF THE DEPARTMENT OF PARKS, OR HIS DESIGNEE, TO EXECUTE ANY DOCUMENTS NECESSARY FOR THIS EXTENSION

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on April 23, 1993, the City and County of San Francisco and the County of San Mateo entered into a Memorandum of Understanding for trail development and conveyance of trail easements on the San Francisco Peninsula Watershed as authorized by the San Francisco Public Utilities Commission; and

 

WHEREAS, the Memorandum of Understanding specified a time period of three years to October 26, 1999 for construction of trail improvements and facilities which time period was previously extended by mutual consent of the City and County of San Francisco and the County of San Mateo to June 27, 2003; and

 

WHEREAS, on January 27, 2004, the City and County of San Francisco Public Utilities Commission adopted Resolution No. 00-0156, and on May 11, 2004, the County Board of Supervisors adopted Resolution No. 066639 authorizing an extension for an additional three years with the new completion date of January 27, 2007; and

 

WHEREAS, on September 25, 2007, the City and County of San Francisco Public Utilities Commission adopted Resolution No. 07-0167 and on October 30, 2007 the County Board of Supervisors authorized Resolution No . 069116 authorizing an extension for an additional three years with a new completion date of October 1, 2010; and

 

WHEREAS, the County of San Mateo has not completed all trail and facility construction and improvements and desires to extend the time period to complete construction.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the San Mateo County Board of Supervisors by adoption of this resolution hereby approves a five-year extension of the facility and trail construction time period as outlined in the Crystal Springs Trail Memorandum of Understanding between the San Francisco Public Utilities Commission and the County of San Mateo, and authorizes the Director of the Department of Parks, or his designee, to execute any documents necessary for the extension of the construction period through October 1, 2015.
