Amendment Three to the Agreement with Liebert & Associates

 

RECOMMENDATION:

Adopt a Resolution authorizing the President of the Board to execute Amendment Three to the Agreement with Liebert & Associates for functional programming services to assist the Sheriff’s Office Jail Planning Unit with pre-architect planning, increasing the amount by $87,425, from $163,900 to $251,325, and extending the term six (6) months from December 31, 2010 to June 30, 2011.

 

BACKGROUND:

In November 2008, a Request for Proposals was developed and posted on the Sheriff’s web page. A selection committee was formed consisting of members from the Sheriff’s Office, Department of Public Works and the Correctional Health Department. The committee interviewed the five respondents and ultimately selected Liebert & Associates as the firm offering the County the best work product, experience and value for this project.

On January 27, 2009, the County and Liebert & Associates entered into an Agreement (Resolution No. 069908) for functional programming services to assist the Jail Planning Unit with pre-architect planning, for a one (1) year term commencing January 1, 2009 through December 31, 2009, and an amount not to exceed $138,900. In addition, the Sheriff was authorized to execute amendments and/or modify the terms of the contract with Liebert & Associates as long as the modified terms remained within the current fiscal provisions.

This past March, the Sheriff executed Amendment One to the contract which extended the term one year to December 31, 2010.

In September, Amendment Two was executed by the Sheriff which increased the County’s maximum fiscal obligation by $25,000, from $138,900 to $163,900. Additional on-site visits were required as a result of the exploration of an alternate site for the replacement jail facility.

 

DISCUSSION:

The proposed Amendment Three to the Agreement with Liebert & Associates expands the scope of work to be performed. The Sheriff’s Office requested additional tasks from Liebert & Associates as a result of the exploration of an alternate site for the replacement jail facility. The original site was the County Office Building (COB) 1 / Motor Pool within the County Government Center, Redwood City. This past June, Chemical Way in Redwood City was proposed as an option for further exploration.

Liebert & Associates will meet with Sheriff’s Office staff and other users groups to discuss the impacts on planned operations and concept designs as a result of the potential site change. Other services provided will be testing the new site to ensure the ability for future expansion, updating the staffing plan and operational costs, and revising the Functional Program Report.

County Counsel has reviewed and approved the Resolution and Amendment as to form.

Approval of this Amendment contributes to the Shared Vision 2025 outcome of a Healthy Community by ensuring a safe and healthy environment for the construction of the replacement jail facility.

FISCAL IMPACT:

Amendment Three increases the amount of the contract by $87,425, from $163,900 to $251,325, and extends the term six (6) months to June 30, 2011. The City of Redwood City has agreed, in principle, to reimburse the Sheriff’s Office for half, or $43,712, of the increased amount. An MOU between the City and County is in the process of being completed and approved. The remaining half, or $43,713, has been included in the Sheriff’s Office Budget for FY 2010-11.
