Agreement with Cedar Street Apartments, Inc. to develop affordable housing

 

RECOMMENDATION:

Adopt a Resolution authorizing:

 

    A.

The President of the Board to execute an Agreement with Cedar Street Apartments, Inc. to develop affordable housing in the amount of $145,488 for the term of October 1, 2010 through June 30, 2013; and

   

    B.

The Director of the Department of Housing or the Director’s designee to execute contract amendments modifying the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modifying the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions

 

BACKGROUND:

In May 2007, the County of San Mateo had approved an Agreement with Mental Health Association (MHA) in the amount of $527,000 to assist with the construction of 15 affordable units at 110 Cedar Street in Redwood City. Since then, MHA formed Cedar Street Apartments, Inc., a Community Housing Development Organization (CHDO) under the HOME Program, to take advantage of the HOME CHDO set-aside funding for the Project.

 

DISCUSSION:

In May 2009, the Board approved $145,488 CHDO funds for Cedar Street Apartments, Inc. This Project will be financed by at least six funding sources, including: HUD Section 811 Supportive Housing for Persons with Disabilities; State HCD; City of Redwood; the State Mental Health Services Act funding; and the County CDBG/HOME. The construction loan will be from California Housing Finance Agency (CalHFA).
CalHFA requires a construction contingency, and as such, the HOME CHDO funds of $145,488 will be used for this specific purpose.
The term of this agreement is October 1, 2010 through June 30, 2013. The agreement and Resolution have been reviewed and approved by County Counsel and Risk Management has reviewed and approved the contractor’s insurance.

 

The contractor has assured compliance with the County’s Contractor Employee Jury service ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

Approval of this Agreement contributes to the Shared Vision 2025 outcome of a livable community by addressing health and safety hazards including, but not limited to, improving existing housing stock in San Mateo County.

FISCAL IMPACT:

The total County obligation under this Agreement is $145,488, funded by the HOME Investment Partnerships Program. This contract amount is included in the Department of Housing Budget for FY 2010-2011. There is no Net County cost.
