SUBJECT:

EXECUTIVE SUMMARY: Public Hearing to consider a Variance to allow a 12-foot front yard setback (where 20 feet is required) on Parcel B of the associated Minor Subdivision. (Appeal of the decision of the Planning Commission to deny this project.)

 

RECOMMENDATION:

Deny the appeal and uphold the Planning Commission’s decision to deny the Variance, County File Number PLN 2010-00221, by adopting the findings of denial included at the end of this report.

   

BACKGROUND:

During the Planning Commission’s hearings for the associated Minor Subdivision, the Commission requested that the applicant explore modifications to the minor subdivision proposal including a variance request. The applicant revised the minor subdivision and submitted an application for a variance. Following the decision to deny the minor subdivision, the Commission also considered the variance and denied the application. This denial has subsequently been appealed by the applicant to the Board of Supervisors.

 

DISCUSSION:

On January 13, 2010, the Planning Commission continued the associated minor subdivision in order for the applicant to explore shifting the rear residence away from the top-of-bank of San Francisquito Creek including requesting a variance for a reduced front yard setback for future development on Parcel B. The applicant proposed a 15-foot setback from the top-of-bank which reduced the building envelope to approximately 830 sq. ft. and reduced the maximum lengths of future east and west residential walls to 8 feet and 29 feet, respectively. The variance application requests a 12-foot front yard setback (where 20 feet is required) to compensate for the smaller building envelope created by the 15-foot setback from the top-of-bank of San Francisquito Creek. The Commission considered the variance application at the August 11, 2010 hearing; however, since the Planning Commission was unable to make the required findings for the associated minor subdivision, the variance application was also denied.

 

The denial of the Variance contributes to the 2025 Shared Vision outcome of a Livable Community by assuring the orderly and beneficial development of residential areas.
