RESOLUTION WAIVING THE REQUEST FOR PROPOSALS (RFP) PROCESS AND AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AMENDMENT TO THE AGREEMENT WITH MIG FOR THE PREPARATION OF THE ENVIRONMENTAL REVIEW REQUIRED IN CONNECTION WITH THE NORTH FAIR OAKS COMMUNITY PLAN UPDATE TO INCREASE THE MAXIMUM AMOUNT EXPENDABLE THEREUNDER BY $130,000, FROM $455,000 TO AN AMOUNT NOT TO EXCEED $585,000, FOR THE TERM SEPTEMBER 15, 2009 THROUGH SEPTEMBER 30, 2011

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, by Resolution No. 70377 of this Board dated September 15, 2009, the President of the San Mateo County Board of Supervisors was authorized to execute an Agreement with MIG (the “Agreement”) for the preparation of the North Fair Oaks Community Plan Update for the term of September 15, 2009 through September 30, 2011, in an amount not to exceed $455,000; and

WHEREAS, it is now necessary for the County to arrange for the environmental review of the North Fair Oaks Community Plan Update pursuant to the requirements of the California Environmental Quality Act (“CEQA”) and CEQA’s implementing Guidelines; and

WHEREAS, this Board has determined that, in light of MIG’s extensive knowledge of the North Fair Oaks Community Plan Update and the County’s process in preparing the Update and MIG’s demonstrated competence, MIG will be able to prepare the environmental review for the Update in an expeditious and cost-effective manner, that the best interest of the County could be served without the necessity of requests for proposals and that the Request for Proposal process should be waived in this case; and

WHEREAS, the County and MIG wish to amend the Agreement to provide that MIG will perform CEQA-required environmental review for the Update and to increase the maximum amount payable under the Agreement by $130,000, to $585,000; and

WHEREAS, there has been presented to this Board for its consideration such an Amendment to the Agreement and, having reviewed it as to both form and content, this Board desires to enter into it.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

1.

The Request for Proposal process is waived with respect to the environmental review services for the North Fair Oaks Community Plan Update; and

2.

The President of the Board of Supervisors is authorized and directed to execute the above-referenced Amendment to the Agreement with MIG for and on behalf of the County of San Mateo and the Clerk of this Board shall attest the President’s signature thereto.
