RECOMMENDATION:

BACKGROUND:

Government Code Section 54956.8 authorizes the legislative body of a local agency to meet in closed session with its negotiator(s) to give instructions on the possible price and terms of payment prior to the purchase, sale, exchange or lease of real property by or for the local agency. However, prior to holding the closed session, the legislative body must hold an open and public session in which it identifies its negotiator(s), the real property or properties which the negotiations may concern, and the person(s) with whom its negotiators may negotiate. Staff recommends that the Board identify the information described above in open session prior to holding a closed session on the matter.

 

County staff has been exploring negotiations concerning the three-way exchange of properties comprising: 1) multiple parcels of vacant property on the coast owned by the County of San Mateo, 2) a ballfield owned by Peninsula Open Space Trust, and 3) a vacant parcel located on Arnold Way east of Main Street, owned by the City of Half Moon Bay. The exchange would facilitate the protection of open space, optimal use of recreation space and development of affordable housing.

 

The negotiator for the County will be the County Manager or his designee. The County will negotiate with Walter T. Moore, acting on behalf of Peninsula Open Space Trust, and/or designated representatives and Michael Dolder, acting on behalf of the City of Half Moon Bay and/or designated representatives.

 

Approval of this recommendation contributes to the Shared Vision 2025 of a Livable Community by supporting the protection of open space, optimal use of recreation space and the development of affordable livable communities for use by the citizens of San Mateo County and, in particular, to residents living In the coastal regions of the County.

 

FISCAL IMPACT:

The transaction involves an exchange of property of comparable value and therefore no compensation.
