RESOLUTION REAFFIRMING THE DECISION OF THE BOARD OF SUPERVISORS TO REJECT AN OFFER FROM STANFORD UNIVERSITY FOR A TRAIL ON ALPINE ROAD

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, under the terms of an Agreement for Trail Easements, Construction, Management and Maintenance and Grant of Easements between the County of Santa Clara and Stanford University, dated January 3, 2006, the University made an offer to the County of San Mateo of $8.4 million to construct a multi-use trail along Alpine Road in unincorporated San Mateo County, which offer required that the trail improvements be completed by December 31, 2011; and

 

WHEREAS, at this Board’s meeting of February 12, 2008, the Board considered the report and recommendations of a subcommittee of the Board, comprised of Supervisor Rich Gordon and former Supervisor Jerry Hill, presented to the Board after a thorough investigation into the pros and cons of accepting the offer; and

 

WHEREAS, based on the recommendations of the subcommittee, and information received at the meeting of February 12, 2008, the Board determined, by a unanimous vote, to reject the offer, and directed the President of the Board to send a letter to the County of Santa Clara and Stanford University advising them of the Board’s decision to reject the offer; and

 

WHEREAS, the Board also directed the President of the Board, in her letter, to express the Board’s strong belief that the $8.4 million proposed for the trail should be immediately paid by Stanford University to the County of Santa Clara, so that these monies might be programmed to be used as mitigation caused by implementation of the General Use Permit issued to Stanford University in 2000, and further urging that the funds be spent by the County of Santa Clara to establish a regional grants program to achieve the goal of mitigating such impacts ; and

 

WHEREAS, the Board is currently of the understanding that $8.4 million that was rejected by the County remains uncommitted and has not been paid to the County of Santa Clara, despite this Board’s rejection of the offer and strong recommendation that the monies be used to establish a regional grants program; and

 

WHEREAS, this Board of Supervisors wishes to reiterate and restate in unmistakable terms its decision to reject the offer and its strong recommendation that the monies be immediately paid to the County of Santa Clara and used to establish a regional grants program;

 

NOW THEREFORE, IT IS HEREBY DETERMINED that this Board of Supervisors reiterates its decision of February 12, 2008, to reject the offer of $8.4 million for the construction of a trail as provided in that certain Agreement for Trail Easements, Construction, Management and Maintenance and Grant of Easements, dated January 3, 2006, by and between the County of Santa Clara and Stanford University; strongly urges Stanford University to immediately pay to the County of Santa Clara the $8.4 million set aside for such trail; and strongly urges the County of Santa Clara to program such funds for the establishment of a regional grants program to mitigate the impacts caused by implementation of the General Use Permit issued to Stanford University in 2000.
