Agreement with Habitat for Humanity Greater San Francisco to Provide $120,000 CDBG Funds to Assist in Rehabilitation of Recently Acquired Foreclosed Homes

 

RECOMMENDATION:

Adopt a Resolution authorizing:

 

    1. The President of the Board to execute an Agreement with Habitat for Humanity Greater San Francisco in the amount of $120,000 for a five-year term to assist in rehabilitation of foreclosed homes acquired under Habitat’s Neighborhood Revitalization Program; and

 

    2. The Director of the Department of Housing or the Director’s designee to execute contract amendments modifying the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modifying the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

 

BACKGROUND:

Habitat for Humanity Greater San Francisco (“Habitat”) is the result of the merger of Peninsula Habitat for Humanity and Habitat for Humanity San Francisco in August 2008. Habitat applied for funding assistance as part of the County’s FY 2010-11 CDBG/HOME Program funding cycle. Funds were requested to assist in its Neighborhood Revitalization Program (NRP), which acquires foreclosed homes in East Palo Alto and the Belle Haven section of Menlo Park to rehabilitate for qualified low-income families. Habitat requested that the funds be provided as a grant.

 

DISCUSSION:

Through a public participation process under the CDBG and HOME Programs, Habitat was allocated $120,000 CDBG funds for the rehabilitation component of its Neighborhood Revitalization Program. The funding allocation was approved by the Board when it approved the County’s FY 2010-11 Action Plan in April 2010.

Under the subject agreement (“Agreement”), $120,000 is provided to Habitat in the form of a grant. In turn, Habitat will fold the County CDBG funds into a larger mortgage to qualified homebuyers whose incomes range from 40 to 60% AMI. Habitat typically provides 100% mortgages at 0% interest to their homebuyers. The Agreement enumerates the business terms of the CDBG funding, including County and HUD compliance requirements. With CDBG funds under the Agreement, Habitat will rehabilitate five foreclosed homes.

 

The term of the Agreement will be five years upon execution. The Resolution and agreement have been reviewed and approved by County Counsel and Risk Management has reviewed and approved the insurance.

 

Habitat has assured compliance with the County’s Contractor Employee Jury service ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to: insurance, hold harmless, non-discrimination and equal benefits.

 

Approval of this Agreement contributes to the Shared Vision 2025 outcome of a Livable Community by addressing health and safety hazards including, but not limited to, improving handicap accessibility, addressing housing code deficiencies and rehabilitating existing housing stock in San Mateo County.

FISCAL IMPACT:

There is no Net County Cost involved. The total County obligation under this Agreement is $120,000, which is funded by Community Development Block Grant (CDBG). This contract amount is included in the Department of Housing Budget for FY 2010-11.
