SUBJECT:

Acceptance and certification of the official canvass of the November 2, 2010, Gubernatorial General Election and declaration of results, candidates elected, and persons appointed in lieu of election pursuant to statute.

 

RECOMMENDATION:

Adopt a Resolution:

A) Accepting the certificate of the Chief Elections Officer as the statement of the result of the vote as determined by the official canvass of the November 2, 2010, Gubernatorial General Election;

 

B) Declaring the person or persons elected to or nominated for certain offices;

 

C) Declaring the person or persons who have filed declarations of candidacy be appointed to certain offices in lieu of holding an election in accordance with Elections Code §10515;

 

D) Declaring the results of certain measures voted on; and

 

E) Declaring the person elected to certain judicial offices in accordance with Elections Code §8203.

 

BACKGROUND:

Elections Code §§10411 and 15300 et seq. authorize and direct the Board of Supervisors and the Chief Elections Officer, within 28 days of an election, to inspect, process, and count all ballots and prepare a certified statement of the result, and to deliver a duplicate of that statement to the Secretary of State and to the chairperson of the county central committee of each political party. Upon acceptance of this statement, Elections Code §15400 authorizes and directs the governing body of the jurisdiction to declare elected or nominated the persons having the highest number of votes for the offices voted on.

 

DISCUSSION:

On November 2, 2010, the Chief Elections Officer conducted a Gubernatorial General Election. The official canvass and an abstract or Statement of the Vote was completed and certified by the Chief Elections Officer and is available at the Registration-Elections Division. An electronic copy of the Statement of the Vote is also published on the Elections web site, www.shapethefuture.org. In the resolution for your adoption, you will be declaring elected: one Member to this Board, the County Treasurer-Tax Collector, and 11 seats for the Superior Court. In addition, there are appointments in lieu of holding elections for the Pescadero Municipal Advisory Council. There are also two countywide measures that passed.

County Counsel has reviewed and approved Resolution as to form.

Approval of this resolution contributes to the Shared Vision 2025 of a Collaborative Community because Elections are an integral part of our democratic process. Elections provide our diverse population an opportunity for civic engagement and collaborative decision making. All stakeholders – voters, candidates, jurisdictions, governing bodies, political parties, academicians, interested individuals and organizations are treated fairly and impartially by the Elections Division. By working collaboratively and transparently with all stakeholders and conducting elections with integrity, the Elections Division fosters faith in the electoral system and confidence in the outcomes of each election.
