RESOLUTION AUTHORIZING THE: 1) PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AMENDMENT NUMBER TWO TO THE SUBLEASE AGREEMENT WITH THE EMPLOYMENT DEVELOPMENT DEPARTMENT (EDD) OF THE STATE OF CALIFORNIA, OF A 7,836 SQUARE FOOT PORTION OF THE LEASED BUILDING AT 550 QUARRY ROAD, SAN CARLOS, EXTENDING THE TERM TO OCTOBER 31, 2011, AT AN INITIAL BASE RENT OF $15,935.73 PER MONTH; AND 2) AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO EXECUTE NOTICES, OPTIONS AND DOCUMENTS ASSOCIATED WITH AMENDMENT NUMBER TWO AND THE AGREEMENT INCLUDING, BUT NOT LIMITED TO, EXTENSION OR TERMINATION OF THE AGREEMENT UNDER THE TERMS SET FORTH THEREIN.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, since 1984, the county Human Services Agency has leased office and warehouse space at 550 Quarry Road in San Carlos for use as a “One-Stop Service Center” serving the Mid-Peninsula; and

 

WHEREAS, on May 14, 2002, the County of San Mateo and the EDD, as authorized by Resolution No. 65247, entered into a Sublease Agreement for a portion of the space at 550 Quarry Road to provide State services in conjunction with the County services offered at the Premises; and

 

WHEREAS, the Sublease expired on October 31, 2010, the EDD has remained in the space on a month-to-month basis in accordance with the Holdover Provision of Agreement, and the parties wish to amend the Sublease Agreement to extend the term for one year through October 31, 2011, and otherwise on the same terms and conditions; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance Amendment Number Two to the Sublease Agreement, reference to which is hereby made for further particulars, which amends and extends the term of the Sublease to October 31, 2011, at an initial base rent of $15,935.73 per month, in accordance with the terms and conditions contained in the First Amendment and Permit Agreement, and

 

WHEREAS, this Board has been presented with Amendment Number Two to the Sublease Agreement and has examined and approved same as to both form and content and desires to enter into same.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute such Amendment Number Two to the Sublease Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to accept or execute on behalf of the County, any and all notices, options and documents associated with Amendment Number Two and Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.
