RESOLUTION WAIVING THE REQUEST FOR PROPOSALS PROCESS (RFP) AND AUTHORIZING THE DISTRICT ATTORNEY TO EXECUTE A SUBSCRIPTION AGREEMENT AND SUBSCRIPTION PLAN AMENDMENT WITH LEXISNEXIS FOR THE PROVISION OF ON-LINE LEGAL RESEARCH SUBSCRIPTION SERVICES FOR THE TERM OF JULY 1, 2010 THROUGH JUNE 30, 2015, FOR AN AMOUNT NOT TO EXCEED $101,460

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a Subscription Agreement and Subscription Plan Amendment between the District Attorney’s office and LexisNexis for the provision of on-line legal research subscription services; and

 

WHEREAS, the District Attorney’s office has contracted with LexisNexis in prior years. The Subscription Agreement and Subscription Plan Amendment with LexisNexis will provide for on-line legal research subscription services for a monthly flat fee of $1,691, commencing July 1, 2010 through June 30, 2015, for a total payment obligation not to exceed $101,460; and

 

WHEREAS, it is in the best interest of the County to waive the Request for Proposals Process because: (1) there is only one other provider, West Publications, of the type of on-line subscription services provided by LexisNexis; (2) the District Attorney opened a competitive proposal process between the two available venders, West Publications and LexisNexis; and (3) no additional training will be required for the attorneys and staff who will be utilizing such on-line services because the District Attorney’s office has utilized LexisNexis’ services in the past; and

 

WHEREAS, it is in the best interest of the County to authorize the execution of the Subscription Agreement and Subscription Plan Amendment between the District Attorney’s office and LexisNexis for a period of five years because LexisNexis provided a competitive proposal that will allow the County to save approximately $21,134 over a period of five years;

 

    NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

 

    The Request for Proposals Process (RFP) is waived and the District Attorney of the County of San Mateo is authorized and directed to execute said Agreement and Amendment.
