Identification of Agency Negotiator, Real Property and Negotiating Parties Prior to Closed Session under Government Code Section 54956.8

 

RECOMMENDATION:

Pursuant to Government Code Section 54956.8, identify the following information prior to holding a closed session for the purpose of giving instructions regarding the possible lease and purchase of real property.

Negotiating Parties: Chemical Way Properties LLC, Las Cruces Holdings LLC, Kona Ventures LLC, Schrader Leask Development Inc and City of Redwood City

For Lease:

Agency Negotiatior(s): County Manager or his designee
Real Property at issue: 50 and 70 Chemical Way, Redwood City
Negotiating Parties: Celine Kearney, Curtis Flamm, Randall Faccinto of Airgas, Inc.; Jeff Birdwell and Dave Hopkins of Sares Regis Group of Northern California, LP; Michael Dingman (or designee) of ValleyCrest Companies.

 
 

BACKGROUND:

Government Code Section 54956.8 authorizes the legislative body of a local agency to meet in closed session with its negotiator(s) to give instructions on the possible price and terms of payment prior to the purchase, sale, exchange or lease of real property by or for the local agency. However, prior to holding the closed session, the legislative body must hold an open and public session in which it identifies its negotiator(s), the real property or properties which the negotiations may concern, and the person(s) with whom its negotiators may negotiate. Staff recommends that the Board identify the information described above in open session prior to holding a closed session on the matter.

 

County staff has been exploring acquisition of four properties comprised of six parcels of real property identified as Assessor’s Parcels: 052-392-270, 052-392-240, 052-392-210, 052-392-260, 052-392-200 and 052-392-190, located at 20, 50, 70 and 80 Chemical Way, Redwood City, owned by Chemical Way Properties LLC, Las Cruces Holdings LLC, Kona Ventures LLC and Schrader Leask Development Inc.

Airgas, Inc. and ValleyCrest Companies are currently tenants in 50 and 70 Chemical Way. Requisition of the fee interest in these properties would involve negotiation of the terms of the respective leases.

 

Approval of this recommendation contributes to the Shared Vision 2025 of a Healthy Community by supporting the outcome of safe neighborhoods for the citizens of San Mateo County.
