Amendment to Agreement with Scott Oesterling, MD

 

RECOMMENDATION:

Adopt a Resolution authorizing the President of the Board to execute an Amendment to the Agreement with Scott Oesterling, MD to provide obstetrics and gynecology services with no change in term, increasing funding by $100,000, to a new maximum fiscal obligation of $4,112,905.60

   

BACKGROUND:

On January 6, 2009, your Board approved an Agreement with Scott Oesterling, MD to provide obstetrics and gynecology services for the term January 1, 2009 through December 31, 2010, in an amount not to exceed $4,012,905.60.

 

DISCUSSION:

There was a calculation error in the original Agreement. In order to pay the contractor the intended amount for the services described in the original Agreement, there needs to be an increase in the funding to allow for the payment.

 

The Amendment and Resolution have been reviewed and approved by County Counsel as to form. Delay in the submission of this Amendment is due to the failure of the vendor to return the signed Amendment in a timely manner.

 

The contractor has assured compliance with the County’s Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

This Agreement contributes to the Shared Vision 2025 outcome of a Healthy Community by providing access to obstetrics and gynecology services to residents of San Mateo County. It is anticipated that less than 15% of all deliveries will be preterm deliveries and less than 25% will be cesarean, which is an indication of the highest quality care.

FISCAL IMPACT:

The term of this Agreement is January 1, 2009 through December 31, 2010. The maximum fiscal obligation is $4,112,905.60. Funds are included in the San Mateo Medical Center (SMMC) FY 2010-11 Adopted Budget.

 

Expenses at SMMC are covered by fees for services or third-party payors whenever possible. The portion of expenses for services provided to the medically indigent or to those covered by programs that do not meet the full costs of care are covered by the County’s General Fund contribution to SMMC.
