SUBJECT:

Permit Agreement with GTE Mobilnet of California Limited Partnership dba Verizon Wireless for a wireless communication facility at the Tower Road Communication Facility (Permit No. 5185).

   

RECOMMENDATION:

Adopt a Resolution authorizing the:

    1. President of the Board of Supervisors to execute a Permit Agreement with GTE Mobilnet of California Limited Partnership dba Verizon Wireless for a wireless communication facility at the Tower Road Communication Facility, at an initial monthly rate of $3,700.00, for a term of five years from September 1, 2011 to August 31, 2016, with one option to extend for an additional five years, and

    2. County Manager or his designee to accept or execute notices, options and documents associated with the Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.

 

BACKGROUND:

In 1991, the County and GTE Mobilnet of California Limited Partnership dba Verizon Wireless (“Permittee”) entered into a Permit Agreement for the installation, construction and operation of a microwave communication facility at the County's Tower Road Communication Facility. Permittee’s facility consists of fenced ground space with an equipment shelter as well as antennae on the existing County owned water tower. Permittee currently pays $3,593.33 per month and the Agreement expires on August 31, 2011. The County and Permittee wish to enter into a new long-term Agreement for the site.

 

DISCUSSION:

Real Property Services has negotiated a Permit Agreement for a term of five years, with one option to extend for an additional five years. The initial monthly fee of $3,700.00 is based on ISD Radio Site Equipment Rates for installed equipment, and is subject to annual escalation of 3%. There are no proposed changes to the Premises or use of the facility. The Planning Department has confirmed that the proposed use is consistent with the existing Use Permit for this facility.

 

County Counsel has reviewed and approved the Permit and Resolution as to form. The Director of Public Works concurs in this recommendation.

 

Approval of the Permit contributes to the Shared Vision 2025 outcome of a Collaborative Community by establishing an agreement that benefits the County of San Mateo and Permittee while also benefiting the public.

 

FISCAL IMPACT:

The fee of $44,400.00 for the initial year of the five-year term will be deposited to the Facilities Account for the Department of Public Works.
