RESOLUTION AUTHORIZING THE COUNTY COUNSEL TO EXECUTE THE FIRST AMENDMENT TO LEGAL SERVICES AGREEMENT WITH COTCHETT, PITRE & MCCARTHY IN THE MATTER OF COUNTY OF SANTA CLARA V. ATLANTIC RICHFIELD COMPANY ET AL.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that
|
|
|
WHEREAS, the presence of lead products for use in paint coatings on homes in buildings in San Mateo County poses serious health hazards. On November 14, 2006, the Board authorized the County’s joining of litigation brought by several cities and counties against certain manufactures of lead based products; and
|
|
|
WHEREAS, the law firm of Cotchett, Pitre and McCarthy (“Cotchett”) has been retained to assist several cities and counties entities in the litigation; and
|
|
|
WHEREAS, the Board of Supervisors approved an agreement with Cotchett for legal services on March 27, 2007; and
|
|
|
WHEREAS, the July 26, 2010 California Supreme Court decision in County of Santa Clara v. Superior Court of Santa Clara County, (2010) 50 Cal.4th 35 requires that the County amend the agreement for legal services to conform with the Court’s decision; and
|
|
|
WHEREAS, the Board of Supervisors has examined and approved an amended agreement with Cotchett for legal services as to form and content and desires to enter into same:
|
|
|
NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the County Counsel is hereby authorized and directed to execute the First Amendment to Legal Services Agreement for and on behalf of the County of San Mateo.
