BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION A) WAIVING THE REQUEST FOR PROPOSALS (RFP) PROCESS AND AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH MACIAS GINI & O’CONNELL LLP FOR THE PROVISION OF FINANCIAL AUDIT SERVICES FOR THE FISCAL YEARS ENDING JUNE 30, 2011, 2012, 2013, AND 2014 FOR A TERM OF APRIL 1, 2011 THROUGH MARCH 31, 2015 IN AN AMOUNT NOT TO EXCEED $1,531,808; AND B) AUTHORIZING THE COUNTY MANAGER TO EXECUTE SUBSEQUENT AMENDMENTS AND MINOR MODIFICATIONS NOT TO EXCEED AN AGGREGATE OF $25,000 AND TO MAKE MINOR CHANGES IN THE TYPES OF SERVICES AND ACTIVITIES PROVIDED UNDER THE AGREEMENT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, Ordinance Code Section 2.92.050 authorizes the Board of Supervisors to waive the Request for Proposals process in any situation where the Board determines that the best interest of the County would be served without the necessity of formal proposals; and

 

WHEREAS, A Request for Proposal (RFP) for audit services was issued in December 2007 for the same scope of services as the recommended agreement. The RFP was sent to twelve firms and advertised twice in a local newspaper. MGO was the only firm that submitted a proposal and the Board of Supervisors awarded a three year contract in April 2008; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an agreement, reference to which is hereby made for further particulars, whereby Macias, Gini & O’Connell LLP will provide post-audits, examination of various County Auditors’ financial statements and for other specified audit work for the years ending June 30, 2011, 2012, 2013, and 2014, for an all inclusive maximum price of $1,531,808; and

 

WHEREAS, it is in the County’s best interests to waive the RFP process and to enter into the Agreement in order to obtain the beneficial contract provisions regarding cost savings and expanded audit coverage as set forth therein; and

 

WHEREAS, this Board has been presented with the form of the Agreement and has examined and approved it as to both form and content and desires to enter into the Agreement.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby authorized and directed to waive the Request for Proposal (RFP) process and execute said Agreement on behalf of the County of San Mateo, and the Clerk of the Board shall attest the President’s signature thereto.

 

BE IT FURTHER RESOLVED, that the County Manager is hereby authorized to execute subsequent amendments and minor modifications not to exceed an aggregate of $25,000 and to make minor changes in the types of services and activities provided under the Agreement.
