RESOLUTION AUTHORIZING THE DIRECTOR OF ENVIRONMENTAL HEALTH TO TRANSFER REGULATORY OVERSIGHT OF THE SMALL PUBLIC WATER SYSTEMS PROGRAM TO THE CALIFORNIA DEPARTMENT OF PUBLIC HEALTH - DRINKING WATER PROGRAM EFFECTIVE JULY 1, 2011

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that
|
|
WHEREAS, pursuant to The California Health and Safety Code, Section 116330, San Mateo County has been delegated by the California Department of Public Health – Drinking Water Program (CDPH-DWP) as the Local Primacy Agency (LPA); and
|
|
WHEREAS, as an LPA the County is charged with regulatory oversight of small public water systems including community water systems with 15 to 200 water connections as well as both transient and non-transient non-community water systems and must meet established state and federal standards; and
|
|
WHEREAS, evaluations by CDPH-DWP continue to note deficiencies in the County’s oversight of the program; and
|
|
WHEREAS, these deficiencies stem from annual permit fees that do not sufficiently cover the true cost of oversight of the program; and
|
|
WHEREAS, a significant increase in annual fees would be detrimental to the operations of these small public water systems; and
|
|
WHEREAS, CDPH-DWP currently regulates water systems with more than 200 connections as well as community water systems throughout California; and
|
|
WHEREAS, CDPH-DWP currently has the infrastructure that can support adding the approximately 30 small public water systems within San Mateo County.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that
the Director of Environmental Health is authorized to transfer regulatory oversight responsibility and all small public water system information to CDPH-DWP effective July 1, 2011.
