RESOLUTION AUTHORIZING THE 1.  PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AGREEMENT WITH D.L. FALK CONSTRUCTION, INC., IN THE AMOUNT OF $944,000 FOR THE RENOVATION OF THE GROUND FLOOR AT THE COASTSIDE CLINIC IN HALF MOON BAY; AND 2.  DIRECTOR OF PUBLIC WORKS TO EXECUTE SUBSEQUENT CHANGE ORDERS UP TO A MAXIMUM AGGREGATE AMOUNT, NOT TO EXCEED $141,600, OR 15% OF THE AGREEMENT AMOUNT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, this Board of Supervisors did, on February 8, 2011, adopt Resolution No. 071258, which adopted plans and specifications, including conformance with prevailing wage scale requirements and calling for sealed bids for the Coastside Clinic Renovation of Ground Floor in Half Moon Bay; and

 

WHEREAS, the Clerk of this Board of Supervisors did, in public on March 8, 2011, open and examine all sealed bids that were received in the specified time for the doing of the work referred to in said Resolution No. 071258; and

 

WHEREAS, this Board of Supervisors has caused an analysis of said bids to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said bids and the analysis thereof; and

 

WHEREAS, the lowest responsible bid was submitted by D.L. Falk Construction, Inc., in the amount of Nine Hundred Forty-Four Thousand and No/100 Dollars ($944,000) based on the estimate of the amount of the work to be done; and

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

 

1.

It is in the best interest of the County of San Mateo to award the agreement for the Coastside Clinic Renovation of the Ground Floor in Half Moon Bay to:

 

D.L. Falk Construction Inc.

3526 Investment Blvd.

Hayward, CA 94545

 

2.

The County of San Mateo shall enter into a written agreement with D.L. Falk Construction, Inc. for the completion of said work as required by the Plans and Specifications adopted by this Board of Supervisors, as hereinbefore mentioned, which Plans and Specifications are on file in the office of the Director of Public Works of the County of San Mateo.

 

3.

The President of this Board of Supervisors shall be, and is hereby, authorized and directed to execute an agreement with D.L. Falk Construction, Inc. for the doing of said work described herein, subject to the Department of Public Works’ receipt and approval of the Faithful Performance Surety Bond (“Performance Bond”) and the Labor and Material Surety Bond (“Payment Bond”) required to be posted by said Contractor with the County of San Mateo in connection herewith.

All payments to the Contractor shall be in accordance with the Plans and Specifications, and other agreement documents. Aggregate payment to the Contractor shall not exceed Nine Hundred Forty-Four Thousand and No/100 Dollars ($944,000).

 

5.

The Director of Public Works is hereby authorized to execute change orders related to said work, not exceeding $141,600 in aggregate.

 

6.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written agreement.
