RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE THE FIFTH AMENDMENT TO THE AGREEMENT WITH THE HEALTH PLAN OF SAN MATEO FOR ADMINISTRATION OF THE CONSOLIDATED ACCESS AND CARE FOR EVERYONE PROGRAM, INCREASING THE NUMBER OF PARTICIPANTS FOR THE THIRD PARTY ADMINISTRATIVE SERVICES AND CHANGING THE NOT-TO-EXCEED AMOUNT BY $84,852 TO A MAXIMUM OF $8,454,852, WITH NO CHANGE IN THE TERM OF JANUARY 1, 2009 TO DECEMBER 31, 2011, OR MAXIMUM CONTRACT OBLIGATION.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on December 9, 2008, this Board executed an Agreement with the Health Plan of San Mateo (HPSM) to administer the benefits provided under the Consolidated Access and Care for Everyone Program (ACE), including payment for indigent medical services, on behalf of the County of San Mateo, for the term of January 1, 2009 to December 31, 2011, for a maximum amount not to exceed $179,370,000; and

 

WHEREAS, on April 28, 2009, this Board executed the First Amendment to the Agreement with the HPSM clarifying contractual terms for audit purposes, allowing for payment to Ravenswood Family Health Center for outside pharmacy services and providing greater flexibility to the HPSM to negotiate rates with medical providers upon written agreement between the Chief of the Health System and HPSM, with no change in the contract term or maximum obligation; and further authorizing the Chief of the Health System or designee to execute contract amendments and/or modify the contract term; and

 

WHEREAS, on April 28, 2009, the Chief of the Health System authorized a Second Amendment to the Contract with the HPSM to adjusting the rate schedule for cardiac services at Seton Medical Center; and

 

WHEREAS, on December 14, 2009, and August 16, 2010, respectively, Third and Fourth Amendments were executed to make minor administrative changes and adjustment in the payment tiers; and

 

WHEREAS, there has been provided to this Board for its consideration and review a Fifth Amendment to the Agreement with the HPSM to adjust the payment tiers and monthly payment amount based on increased enrollment, with no change in the maximum obligation or term; and

 

WHEREAS, this Board has considered the Fifth Amendment to the Agreement as to both form and content and desires to enter into it.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND that the President of the Board be and is hereby authorized and directed to execute said Fifth Amendment to the Agreement for the administration of the Consolidated ACE Program, including payment for indigent medical services, for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.
