RESOLUTION: A) WAIVING THE REQUEST FOR PROPOSALS PROCESS AND AUTHORIZING THE CHIEF OF THE HEALTH SYSTEM TO EXECUTE A THIRD AMENDMENT TO THE AGREEMENT WITH PENINSULA HUMANE SOCIETY & SPCA TO PROVIDE ANIMAL CONTROL AND LICENSING SERVICES TO THE COUNTY AND THE TWENTY CITIES OF THE COUNTY, EXTENDING THE TERM OF THE CONTRACT AND THE LAND LEASE FROM JUNE 17, 2003 THROUGH JUNE 30, 2015, AND INCREASING THE MAXIMUM OBLIGATION BY $22,206,977 TO A NEW MAXIMUM OBLIGATION OF $61,209,045; AND B) AUTHORIZING THE CHIEF OF THE HEALTH SYSTEM TO EXECUTE A THIRD AMENDMENT TO THE AGREEMENT WITH THE TWENTY CITIES OF THE COUNTY FOR THE PROVISION OF ANIMAL CONTROL SERVICES, EXTENDING THE TERM THROUGH JUNE 30, 2015

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, Ordinance Code Section 2.83.170 authorizes the Board of Supervisors to waive the Request for Proposals process in any situation where the Board of Supervisors determines that the best interest of the County could be served without the necessity of proposals; and

 

WHEREAS, on June 17, 2003, the Board of Supervisors adopted Resolution 066067 approving an Agreement with The Peninsula Humane Society & SPCA (PHS) for shelter and field animal control services for the entire County, and Resolution 066066 approving an Agreement with the twenty cities of the County to provide animal control services; and

 

WHEREAS, on December 14, 2004, the Board of Supervisors adopted Resolution 067089 approving (1) an amendment to the Agreement with PHS for shelter and field animal control services for the entire County; (2) an amendment of a land lease with PHS for certain land at Coyote Point and; (3) an amendment with the twenty cities of the County to provide animal control services and; to extend the term of all Agreements that were set to expire on July 1, 2006, through June 30, 2008; and

 

WHEREAS, on April 24, 2007, the Board of Supervisors adopted Resolution 068664 authorizing the Health Director to execute an amendment to the Agreement to extend the term of all three Agreements through June 30, 2011; and

 

WHEREAS, the County and other parties wish to 1) amend the Agreement with Peninsula Humane Society & SPCA to extend the term through June 30, 2015 and increase the Agreement amount by $22,206,977; and 2) amend the Agreement with the twenty cities of the County to extend the term through June 30, 2015.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the RFP process is hereby waived.

 

BE IT FURTHER RESOLVED that the Chief of the Health System is hereby authorized and directed to execute the Third Amendment with Peninsula Humane Society & SPCA for and on behalf of the County of San Mateo.

 

BE IT FURTHER RESOLVED that the Chief of the Health System is hereby authorized and directed to execute the Third Amendment with the twenty cities of the County for and on behalf of the County of San Mateo.
