RESOLUTION WAIVING THE REQUEST FOR PROPOSALS PROCESS AND AUTHORIZING THE COUNTY PURCHASING AGENT TO ISSUE PURCHASE ORDERS TO QS/1 DATA SYSTEMS TO PROVIDE PROPRIETARY LICENSED SOFTWARE, MAINTENANCE, UPGRADES AND SUPPORT FOR THE TERM OF JULY 1, 2010 THROUGH JUNE 30, 2012, FOR A MAXIMUM OBLIGATION OF $150,000.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, in December 2010 the County purchased the NRx software system from QS/1 Data Systems (QS/1) to dispense outpatient prescriptions in the San Mateo Medical Center (SMMC)’s primary care unit; and

 

WHEREAS, in December 2010 the California Department of Public Health (CDPH) found that SMMC was not in compliance with Title 22 of the California Code of Regulations because SMMC had not assumed overall responsibility for outpatient prescriptions filled at its Burlingame Long-Term Care and the San Mateo Long-Term Care facilities; and

 

WHEREAS, the CDPH has accepted SMMC’s Plan of Correction to implement the NRx Software in SMMC’s long term-care facilities in order to address the Title 22 compliance issue by July 1, 2011; and

 

WHEREAS, Ordinance Code Section 2.83.170 authorizes the Board of Supervisors to waive the Request for Proposals process in any situation where the Board of Supervisors determines that the best interest of the County could be served without the necessity of proposals; and

 

WHEREAS, SMMC has requested a waiver of the Request for Proposals (RFP) process in relation to utilizing QS/1’s software at its long-term care facilities because the QS/1 software is already used at SMMC and there is a pressing need to implement a resolution to the Title 22 requirements issue as soon as possible to support appropriate patient care; and

 

WHEREAS, this Board has determined it to be in the best interest of the County to authorize the waiver of the RFP process to permit QS/1 to provide the NRx prescription software for SMMC’s long-term care facilities; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a request to authorize the County Purchasing Agent to issue purchase order to QS/1 for the upgrade of the NRx software to include the long-term care facilities for the term of July 1, 2010, through June 30, 2012, for a maximum obligation of $150,000.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Request for Proposal process is waived and the County Purchasing Agent is authorized to issue purchase orders to QS/1 for the NRx software upgrade and associated support for the term for July 1, 2010, through June 30, 2012, in an amount not to exceed $150,000 for SMMC’s long-term care facilities.
