Agreement with Children’s Health Council

 

RECOMMENDATION:

Adopt a Resolution authorizing the:

A) President of the Board to execute an Agreement with Children’s Health Council for the provision of non-public school-based mental health services for emotionally and behaviorally disturbed children and adolescents, and outpatient managed care mental health services for developmentally disabled clients authorized by the Mental Health Plan, for the term July 1, 2011 through June 30, 2012, for a maximum obligation of $534,980; and

 

B) Chief of the Health System or designee to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

 

BACKGROUND:

For over fourteen years Children’s Health Council (CHC) has provided intensive non-public school-based mental health services for San Mateo County children with complex emotional, behavioral, and developmental problems. Children are placed at CHC by local school districts throughout the County through Individual Education Plan (IEP) team processes. The IEP team includes the youth’s parent(s) or guardian(s), and representatives from the public school district and Behavioral Health and Recovery Services (BHRS). Under the current memorandum of understanding (MOU) between BHRS and the San Mateo County Office of Education - Special Education Local Participation Area (SELPA), BHRS will provide school-based mental health services to students within SELPA pursuant to the terms and conditions of the MOU. Under the B-1 Administrative Memorandum, school-based mental health services are exempt from the County Request for Proposals (RFP) requirement.

 

Since 2006 CHC has provided outpatient managed care mental health services. In September 2006 the B-1 memo was revised to allow the exemption of individual providers of outpatient managed care mental health services from the RFP process, and the County began contracting with “any qualified provider”. Agency providers were not included in the exemption. In May 2007 BHRS ran an RFP for outpatient managed care mental health services provided by an agency to identify new potential providers and to ensure fair selection. CHC did not respond to the RFP; however, CHC continued to deliver school-based mental health services. In 2009 BHRS identified the need to provide outpatient managed care mental health services to developmentally disabled clients who were currently underserved. CHC was identified as the only agency providing mental health services to the developmentally disabled population. In 2010 your board approved a waiver of the RFP requirement for agencies for the provision of outpatient managed care mental health services. CHC was one of several agencies included in that waiver.

 

DISCUSSION:

CHC provides non-public school-based mental health services and outpatient managed care mental health services authorized through the MHP. Services will include medication assessment and treatment; classroom interventions; individual, group, and family therapy; plan development; crisis intervention; and referrals to community services.

 

The Agreement and Resolution have been reviewed and approved by County Counsel. The Contractor’s insurance has been reviewed and approved by Risk Management.

 

The Contractor has assured compliance with the County’s Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

The Agreement contributes to the Shared Vision 2025 outcome of a Healthy Community by providing non-public school-based mental health services for emotionally disturbed children and adolescents. BHRS provides a range of services to promote wellness and recovery and to support consumers remaining in the lowest possible level of care. The provision of intensive mental health services for youth is one established level of care. The services provided through this Agreement contribute to this measure. It is anticipated that 76% of clients will be maintained at their current or lower level of care.

FISCAL IMPACT:

The term of the Agreement is July 1, 2011 through June 30, 2012, and the maximum obligation is $534,980. Of that amount, it is anticipated that Medi-Cal Federal Financial Participation will fund $90,000, Medicare will fund $10,000, private payors will fund $43,497, the County Office of Education will fund $365,765, and Healthy Kids will fund $13,049. The remaining $12,669 is Net County Cost. Funds for these services are included in the BHRS FY 2011-12 Recommended Budget.
