BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

    RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE A GRANT AGREEMENT WITH THE STATE WATER RESOURCES CONTROL BOARD FOR THE JAMES V. FITZGERALD AREA OF SPECIAL BIOLOGICAL SIGNIFICANCE POLLUTION REDUCTION PROGRAM IN THE AMOUNT OF $2,300,000

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

    WHEREAS, the State Water Resources Control Board (State Water Board) has determined that the County of San Mateo is eligible to receive funds from the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006 (Proposition 84) Clean Beaches Program; and

 

    WHEREAS, the County of San Mateo will use these funds for the James V. Fitzgerald Area of Special Biological Significance Pollution Reduction Program, a project designed to comply with the discharge prohibitions into Areas of Special Biological Significance contained in the California Ocean Plan eligible project costs; and

 

    WHEREAS, the County of San Mateo is authorized to enter into a financial assistance agreement with the State Water Board.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

 

1.

The President of the Board is authorized to execute a Grant Agreement with the State Water Resources Control Board for the James V. Fitzgerald Area of Special Biological Significance Pollution Reduction Program, (Agreement No. 10-402-550) in the amount of $2,300,000.

 

2.

The Board agrees and further does authorize the President of the Board to certify that the County of San Mateo has and will comply with all applicable federal and state statutory and regulatory requirements related to any financial assistance funds received through the Grant Agreement.

 

3.

The Board agrees and further does authorize the President of the Board to certify that all financial assistance received from the State Water Board for the James V. Fitzgerald Area of Special Biological Significance Pollution Reduction Program shall only be used for “reimbursable costs” as defined in the Proposition 84 Areas of Special Biological Significance Grant Program Guidelines, adopted by the State Water Board on April 1, 2008.
