Amendment to the Resolution Authorizing the Director of Public Works to distribute Public, Educational, and Governmental Access Capital Grant Funds to the PEG access provider for the County coastside area

 

RECOMMENDATION:

Adopt a Resolution amending Resolution No. 067917 to authorize the Director of Public Works to distribute Public, Education, and Governmental access capital grant funds to the Public Education, and Governmental access provider for the County coastside area.

 

BACKGROUND:

On April 4, 2006 the County of San Mateo entered into a cable system franchise agreement with Comcast that requires Public, Education, and Governmental (PEG) access channels be broadcast to their subscribers in Moss Beach, Montara, El Granada, Princeton, Pescadero, and La Honda. The franchise agreement provides that the County is to receive $379,908 in PEG access capital grant funds (PEG grant funds) over the 15-year term agreement. The distribution of these funds is at the sole discretion of the County.

 

Concurrent with the execution of the Comcast franchise agreement, your Board adopted Resolution No. 067917, which authorized the Director of Public Works to distribute $231,042 in PEG grant funds to Mid-Coast Television, Inc. (MCTV) for the reimbursement of PEG capital equipment. MCTV has been the PEG provider for the coastal areas since 1995 and has received $154,837.86 in reimbursements to date in connection with PEG grant funds available from the franchise agreement. There is a balance of $8,044.14 from the last Comcast payment made in 2007, which can be distributed to MCTV for items eligible for reimbursement that were either purchased prior to June 7, 2011, or purchased with prior County approval before September 11, 2011.

 

DISCUSSION:

Resolution No. 067917 provides that a total of $68,160 in PEG grant funds be distributed to MCTV, as the PEG access provider for the County coastside area, from the May 2011 and May 2016 payments. If the Board, however, approves the execution of an agreement with a provider other than MCTV, MCTV will no longer be the PEG access provider for the County coastside after September 11, 2011. It is recommended that the PEG grant funds from the 2011 and 2016 payments be made available to the PEG access provider that will be providing services on or after September 12, 2011 and beyond, under the same conditions as the funding was available to MCTV.

 

Accordingly, it is recommended that Resolution No. 067917 be amended to provide that Director of Public Works distribute the PEG grant fund payments to the PEG access provider who will be providing such services on or after September 12, 2011 in accordance with the applicable agreement for services.

 

County Counsel has reviewed and approved the Resolution as to form.

 

Approval of this action will contribute to the Shared Vision 2025 outcome of a

Collaborative Community by providing PEG grant funds for the delivery of PEG channel programming to our residents on the coast.

 

FISCAL IMPACT:

The funding for these payments will be paid from PEG Access Capital portion of the cable budget. There is no impact to the General Fund.
