SUBJECT:

Colma Creek Flood Control Channel Wall Repair Project Upstream of Spruce Avenue in the City of South San Francisco

[Project No. FCB02, Plan File No. 1/4882]

 

RECOMMENDATION:

Acting as the governing board of the San Mateo County Flood Control District, adopt a Resolution:

 

1.

Adopting plans and specifications, including conformance with prevailing wage scale requirements for the Colma Creek Flood Control Channel Wall Repair Project; and

   

2.

Authorizing the President of the Board of Supervisors to execute an agreement with ProVen Management, Inc., in the amount of $2,290,280, for the entire work listed in the Base and Add Alternate Schedules for the Colma Creek Flood Control Channel Wall Repair Project; and

 

3.

Authorizing the Director of Public Works to execute subsequent change orders to grant time extensions for project completion and payment up to a maximum aggregate amount not to exceed $230,000, or approximately 10% of the agreement amount.

 

BACKGROUND:

On January 25, 2011, your Board adopted Resolution No. 071229, which certified the Initial Study/Mitigated Negative Declaration (IS/MND), dated August 26, 2010, for the Colma Creek Flood Control Channel Wall Repair Project (Project) and authorized the Director of Public Works to prepare plans and specifications for the Project, proceed with advertising for bids on the Project, and report back to this Board with recommendations on awarding a contract. The certification of the IS/MND and the adoption of the Mitigation Monitoring and Reporting Program as conditions of project approval ensured compliance with the California Environmental Quality Act.

 
 

The Department has obtained all necessary Federal and State permits for the Project.

 

DISCUSSION:

On Thursday, May 19, 2011, bids were accepted for this project and subsequently referred to this office for checking and recommendation. The bid of ProVen Management, Inc. at $2,290,280 was the lowest responsible bid received for the entire work. The Engineer's estimate for the entire work listed in the Base and Add Alternate Schedules was $3,315,000. A summary of the bids received is attached as Exhibit “A”.

 

The proposed Project involves the construction of a U-shaped concrete channel from upstream of the Spruce Avenue Bridge to immediately downstream of the Spruce Avenue Bridge. The U-shaped concrete channel will remove the current risk of channel bottom scour, improve the geotechnical reliability of the channel, provide long-term functionality, and protect the channel immediately upstream of the Project and the Spruce Avenue Bridge area. The Add Alternate option is related to the additional work required to divert water creating a dry work area during the course of construction project.

 

Staff reviewed the bid documents and has determined that the Equal Employment program submitted by ProVen Management, Inc. is in accordance with the current Equal Employment Guidelines and that the Contractor complies with the equal benefits and jury duty pay provisions of the County ordinance code.

 

County Counsel has reviewed and approved the Resolution and Agreement as to form.

 

Approval of these actions contribute to the Shared Vision 2025 outcome of a Healthy Community by maintaining the integrity of the flood control facility and adjacent infrastructure for the benefit of the public.

 

FISCAL IMPACT:

This contract is awarded for the aggregate amount of the “Base” and “Add Alternate” schedules. The total estimated cost for construction is $2,520,280, which includes authorization for up to $230,000 in change orders as the work is bid on a unit price basis. The contingency is used to pay the Contractor for any unforeseen conditions not anticipated in the construction agreement documents. The project is proposed to be financed with District Funds that have been budgeted for this work. There is no impact to the General Fund.
