Law Enforcement Services Agreement and Initial Transfer Agreement with the City of Half Moon Bay

 

RECOMMENDATION:

A.

Adopt a Resolution authorizing the:

1.

President of the Board to execute an Agreement with the City of Half Moon Bay for the provision of transferring personnel and equipment to the County effective June 12, 2011 to effectuate the transfer of law enforcement services from the Half Moon Bay Police Department to the Sheriff’s Office;

2.

President of the Board to execute an Agreement with the City of Half Moon Bay for the provision of law enforcement services provided by the Sheriff’s Office, for a term commencing June 12, 2011 through June 30, 2016, with the option to renew for three additional three-year terms, with reimbursement to the County in the amount of $2,281,332 for FY 2011-12; and

3.

Sheriff or Sheriff’s designee to accept or execute notices, documents and amendments associated with these Agreements under the terms set forth.

B.

Resolution authorizing a transfer request in the amount of $118,750 from Unanticipated Revenue to the Sheriff’s Office Budget for expenditure of salaries and benefits. (4/5ths vote required)

 

BACKGROUND:

In March 2009, the City of Half Moon Bay experienced a significant Citywide reorganization due to a land use litigation judgment against the City. As a result, many positions were eliminated along with other budget reductions.

In 2010, the City of Half Moon Bay determined it could no longer provide police services at desired service levels within the City’s adopted and projected budgets.

At the beginning of this year, the City requested proposals from law enforcement agencies capable of providing general and specialized law enforcement and traffic services to the City of Half Moon Bay. Proposals were submitted by the Pacifica Police Department and the Sheriff’s Office.

At a special study session held on April 2nd, the Sheriff’s Office was identified as the preferred provider and the Half Moon Bay City Council voted to begin contract negotiations.

On May 24th, this Board introduced a salary ordinance amendment adding six (6) Deputy Sheriffs and one (1) Sheriff’s Criminal Records Supervisor for a total of seven (7) positions to the Sheriff’s Office for the purpose of providing contract law enforcement services to the City of Half Moon Bay. The ordinance amendment will take effect on June 12, 2011.

 

DISCUSSION:

The purpose of the Transfer Agreement is to facilitate the orderly transfer of assets, programs, costs and personnel from the Half Moon Bay Police Department to the County for the provision of law enforcement services to the citizens and properties within the City of Half Moon Bay. The contract outlines the initial startup of the new law enforcement services model for the City. It also covers all of the specific one-time startup costs associated with personnel, equipment, facility items and technology related issues. The Transfer Agreement also covers all other details necessary to ensure the smooth and successful transition of the City’s law enforcement services and personnel to the County in anticipation of the June 12, 2011 effective date.

The Law Enforcement Services Agreement outlines the services that will be provided to the City by the Sheriff’s Office. Key service features include: guaranteed 24-hour a day patrol services; maintaining existing response times; City access to increased number of detectives including investigative resources, Reserve Officers and public safety volunteers for City events; and provision for additional dedicated personnel in the event of a large scale emergency to assist in managing crisis situations.

The reimbursement rates will be adjusted by the County annually and become effective July 1 of each year of the five (5) year term and attached as an amendment to the Agreement. The Agreement contains the option to renew for three additional three-year periods, to June 30, 2019, June 30, 2022, and June 30, 2025, respectively, by mutual agreement of the Sheriff’s Office and the City of Half Moon Bay.

Both the Transfer Agreement and the Law Enforcement Agreement will be recommended for approval by the Half Moon Bay City Council at their regularly scheduled meeting this evening, June 7, 2011.

County Counsel has reviewed and approved the Resolution, Transfer Agreement and Law Enforcement Services Agreement as to form.

Approval of both agreements contributes to the Shared Vision 2025 outcome of a Healthy Community by ensuring the neighborhoods of Half Moon Bay are safe and the transition of law enforcement services from the City to the County is seamless.

 

FISCAL IMPACT:

The Law Enforcement Services Agreement is for a term commencing June 12, 2011 through June 30, 2016. The ATR recognizes revenue and appropriates salary & benefit costs of the contract for FY 2010-11 in the amount of $118,750. The revenue for FY 2011-12 in the amount of $2,281,332 will be added to the Sheriff’s Office Budget through the June revision process. There is no Net County Cost.
