BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AGREEMENT WITH PACIFICA COMMUNITY TELEVISION FOR PUBLIC, EDUCATION, AND GOVERNMENTAL ACCESS TELEVISION SERVICES FOR THE MOSS BEACH, MONTARA, EL GRANADA, PRINCETON, PESCADERO, AND LA HONDA AREAS,

EFFECTIVE JUNE 7, 2011 TO JUNE 30, 2015.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County of San Mateo is a franchising authority for a portion of the cable television distribution system operated by Comcast; and

WHEREAS, the Board of Supervisors approved a Cable Franchise Agreement with Comcast on April 4, 2006 in which there are requirements that Public, Education, and Governmental Access (PEG Access) be provided to their subscribers; and

WHEREAS, the Board of Supervisors designated Mid-Coast Television, Inc. (MCTV) as the provider of PEG Access for the unincorporated area of the County coastside including Moss Beach, Montara, El Granada, Princeton, Pescadero, and La Honda through an Agreement between the County and MCTV that was executed on September 12, 1995; and

WHEREAS, the Agreement has automatically renewed four times, in September 1998, September 2001, September 2004, and September 2007; and

WHEREAS, this Board of Supervisors did, on May 11, 2010, adopt Resolution No. 070761, which authorized the execution of an Amendment to the Agreement with MCTV for one additional year with a termination date of September 11, 2011, authorized the Director of Public Works to send a notice of intent to MCTV that the Agreement would not automatically be extended for an additional three-year term, and directed staff to prepare a request for proposals for a PEG access provider on the County coastside; and

WHEREAS, the City of Half Moon Bay maintains a similar agreement with MCTV, which they have amended to allow for a termination date consistent with the County executed Amendment; and

WHEREAS, the County and City of Half Moon Bay worked collaboratively through a Request for Proposal process to select a PEG access provider; and

WHEREAS, the Director of Public Works is recommending that Pacifica Community Television (PCT) be the PEG access provider for the unincorporated area of the County coastside, including Moss Beach, Montara, El Granada, Princeton, Pescadero, and La Honda through an Agreement between the County and PCT; and

WHEREAS, the Board has been presented with a form of such Agreement between PCT and the County and has examined and approved same as to both form and content, and desires to enter into same; and

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

The President of the Board is authorized to execute the Agreement between the County of San Mateo and Pacifica Community Television for Public, Education, and Governmental Access Television Services for the Moss Beach, Montara, El Granada, Princeton, Pescadero, and La Honda areas.

2.

The Clerk of the Board of Supervisors, County of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written agreement.
