RESOLUTION AMENDING RESOLUTION NO. 067917 TO AUTHORIZE THE DIRECTOR OF PUBLIC WORKS TO DISTRIBUTE PUBLIC, EDUCATION, AND GOVERNMENTAL ACCESS CAPITAL GRANT FUNDS TO THE PUBLIC, EDUCATION, AND GOVERNMENTAL ACCESS PROVIDER FOR THE COUNTY COASTSIDE AREA.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on April 6, 2006, the County entered into a Cable System Franchise Agreement with Comcast of California, IX, Inc., Comcast of California/Colorado/Florida/Oregon, Inc., Comcast of California/Illinois, LP and Comcast of California/Colorado/Washington, LP (collectively “Comcast”) that requires the broadcasting of Public, Education, and Governmental (PEG) access channels to their subscribers in Moss Beach, Montara, El Granada, Princeton, Pescadero, and La Honda; and

 

WHEREAS, the Comcast cable Franchise Agreement provides that the County is to receive $379,908 in PEG access capital grant fund (PEG grant funds) payments over the 15-year term of the Franchise Agreement and that the distribution of these funds is at the sole discretion of the County; and

 

WHEREAS, since 1995, the County has had an agreement with Mid-Coast Television, Inc. (MCTV), which designated MCTV as the PEG access provider for these coastal areas and on April 4, 2006, the Board adopted Resolution No. 067917, which authorized the Director of Public Works to distribute PEG grant funds to MCTV in accordance with the payment schedules stipulated in the Comcast Franchise Agreement; and

 

WHEREAS, the Board desires to amend Resolution No. 067917 in order to provide that the distribution of PEG grant funds for the May 2011 and May 2016 payments from Comcast be made to the County coastside PEG access provider that will be providing services from September 12, 2011 and beyond, under the same conditions as the funding was available to the current provider.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the directions to the Public Works Director set forth in Resolution No. 067917 are to be superseded by the following directions, and as such Resolution No. 067917 is amended to read as follows:

 

The Director of Public Works is hereby directed to distribute PEG Capital Grant funds as described below to the County coastside PEG access provider designated by the County to provide such services commencing September 12, 2011, after payments are made to the County by Comcast as provided by the Franchise Agreement with Comcast. The distribution of funds to the County coastside PEG Access provider will be made after County receives funds from Comcast and after the County coastside PEG Access provider has submitted signed purchase orders or receipts for PEG capital equipment requested and purchased by the County coastside PEG Access provider:
