RESOLUTION AUTHORIZING THE:

1.

PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH THE CITY OF HALF MOON BAY FOR THE PROVISION OF TRANSFERRING PERSONNEL AND EQUIPMENT TO THE COUNTY EFFECTIVE JUNE 12, 2011 AS A RESULT OF TRANSFERRING LAW ENFORCEMENT SERVICES FROM THE HALF MOON BAY POLICE DEPARTMENT TO THE SHERIFF’S OFFICE;

2.

PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH THE CITY OF HALF MOON BAY FOR THE PROVISION OF LAW ENFORCEMENT SERVICES PROVIDED BY THE SHERIFF’S OFFICE, FOR A TERM COMMENCING JUNE 12, 2011 THROUGH JUNE 30, 2016, WITH THE OPTION TO RENEW FOR THREE ADDITIONAL THREE-YEAR TERMS, WITH REIMBURSEMENT TO THE COUNTY IN THE AMOUNT OF $2,281,332 FOR FY 2011-12; AND

3.

SHERIFF OR SHERIFF’S DESIGNEE TO ACCEPT OR EXECUTE NOTICES, DOCUMENTS AND AMENDMENTS ASSOCIATED WITH THESE AGREEMENTS UNDER THE TERMS SET FORTH.

 
 

    RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

    WHEREAS, in 2010, the City of Half Moon Bay determined it could no longer provide police services at desired service levels within the City’s adopted and projected budgets; and

    WHEREAS, at the beginning of 2011, the City requested proposals from law enforcement agencies capable of providing generalized and specialized law enforcement and traffic services to the City of Half Moon Bay; and

    WHEREAS, proposals were submitted by the Pacifica Police Department and the Sheriff’s Office; and

    WHEREAS, on April 2, 2011, the Half Moon Bay City Council identified the Sheriff’s Office as the preferred provider and the Council voted to begin working with the Sheriff’s Office to develop a proposed Transfer Agreement and Law Enforcement Services Agreement; and

    WHEREAS, on the evening of June 7, 2011, the Half Moon Bay City Council will vote to approve both the Transfer Agreement and Law Enforcement Services Agreement; and

    WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a Transfer Agreement, reference to which is hereby made for further particulars, whereby the orderly transfer of assets, programs, costs and personnel from the Half Moon Bay Police Department to the County for the provision of law enforcement services to the citizens and properties within the City of Half Moon Bay shall take effect on June 12, 2011; and

    WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a Law Enforcement Services Agreement, reference to which is hereby made for further particulars, whereby the Sheriff’s Office shall provide the City of Half Moon Bay with law enforcement services, commencing June 12, 2011 through June 30, 2016, with the option to renew three additional three-year periods, with reimbursement to the County in the amount of $2,281,332 for FY 2011-12; and

    WHEREAS, both parties now wish to enter into the Agreements, to provide for the transfer of assets, programs, costs and personnel from the Half Moon Bay Police Department to the County in turn to receive law enforcement services; and

    WHEREAS, this Board has been presented with a form of such Agreements and has examined and approved same as to both form and content, and desires to enter into same:

    NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the:

1.

President of this Board of Supervisors be, and is hereby authorized to, execute the Transfer Agreement with the City of Half Moon Bay, for and on behalf of the County of San Mateo, and the Clerk of this Board of Supervisors shall attest the President’s signature thereto;

2.

President of this Board of Supervisors be, and is hereby authorized to, execute the Law Enforcement Services Agreement with the City of Half Moon Bay, for and on behalf of the County of San Mateo, and the Clerk of this Board of Supervisors shall attest the President’s signature thereto; and

3.

Sheriff or Sheriff’s designee is hereby authorized to accept or execute notices, documents and amendments associated with these agreements under the terms set forth.
