BOARD OF SUPERVIORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION RATIFYING THE MEMORANDUM OF UNDERSTANDING WITH THE CITY AND COUNTY OF SAN FRANCISCO REGARDING THE APPLICATION OF THE SAN FRANCISCO LOCAL HIRING POLICY FOR CONSTRUCTION LOCATED WITHIN SAN MATEO COUNTY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, County desires to protect the interests of its residents by providing them increased opportunity for employment on all construction projects located in the County of San Mateo, including projects for the City and County of San Francisco; and

 

WHEREAS, on January 23, 2011, the City and County of San Francisco enacted an ordinance (the “SF Local Hiring Ordinance”) which established a local hiring policy that effectively requires contractors and their subcontractors performing public works projects for the City and County of San Francisco to fill their work force with certain percentages of San Francisco residents. The percentage requirements reach up to and including 50% of the workers on a project; and

 

WHEREAS, the SF Local Hiring Ordinance extends to projects at sites located up to 70 miles beyond the jurisdictional limits of San Francisco – thereby covering the entirety of San Mateo County; and

 

WHEREAS, in order to protect the interests of its residents, the County of San Mateo negotiated a Memorandum of Understanding (“MOU”) with the City and County of San Francisco regarding the application, within the County of San Mateo, of the local hiring policy as established by the SF Local Hiring Ordinance; and

 

WHEREAS, the MOU provides for the equal status of San Mateo County residents and residents of San Francisco on San Francisco projects within San Mateo County; and

 

    WHEREAS, the MOU also calls for contractors to strive to balance their compliance with San Francisco’s mandatory participation levels by hiring an equal number of San Mateo County residents and San Francisco residents, and allows contractors and subcontractors working on San Francisco projects within the County of San Mateo to request conditional waivers from the applicable mandatory participation level under the SF Local Hiring Ordinance by sponsoring apprentices from graduates of San Mateo County’s Project Build; and

 

WHEREAS, the MOU was signed on June 2, 2011 by San Mateo County’s Board President Groom and San Francisco’s Mayor Lee.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the County of San Mateo Board of Supervisors hereby confirms, authorizes and ratifies the Memorandum of Understanding Between the City and County of San Francisco and the County of San Mateo Regarding the Application of the San Francisco Local Hiring Policy For Construction Located Within San Mateo County.
