RESOLUTION AMENDING THE FIRE MARSHAL SERVICE FEE SCHEDULE TO INCLUDE FEES FOR RESPONSE TO FALSE FIRE ALARMS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, San Mateo County Ordinance Code section 3.84.060 designates the San Mateo County Fire Marshal, under the direction of the County Fire Chief, as the official designated to enforce the Fire Code for the unincorporated area of the County of San Mateo, not covered by a Fire Protection District;

 

WHEREAS, Sections 3.84.280 and 3.84.290 of the San Mateo County Ordinance Code provide that certain persons, including but not limited to owners who fail to properly maintain fire alarm systems or who transmit false alarms during maintenance without first alerting the Fire Department, shall be responsible for payment of costs related to the fire response service received by that person due to the false alarm; and

WHEREAS, on May 17, 2005, this Board adopted a Fire Marshal Fee Schedule by Resolution No. 067300 of this Board; and

 

WHEREAS, this Board has reviewed the fees shown in Attachment A hereto, the basis of their calculation and the justification for the fees as set forth in the staff report submitted to the Board in this matter, and finds the fees to be limited to recovery of the costs of responding to a false alarm.

 

    NOW THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED that this Board hereby amends the Fire Marshal Service Fee Schedule to include the cost recovery fees and exemptions shown in Attachment A to this Resolution, and directs the Planning Director or designee to collect the fees as shown thereon and deposit them in the County treasury.
