SUBJECT:

Agreement, Deed and Grant of Easement with Oleg Vigdorchik and Viktoriya Vigdorchik for an Emergency Vehicle Turnaround Easement located at 647 Acacia Lane in Redwood City.

RECOMMENDATION:

Adopt a Resolution authorizing the:

    1. President of the Board of Supervisors to execute an Agreement, Deed and Grant of Easement with Oleg Vigdorchik and Viktoriya Vigdorchik for an Emergency Vehicle Turnaround Easement located at 647 Acacia Lane in Redwood City, accepting an easement for an emergency vehicle turnaround and the installation and maintenance of the turnaround as a condition of approval for the subdivision of the property; and

    2. County Manager or his designee to record the Agreement and execute and accept any and all notices and documents associated with the Agreement including, but not limited to, a certificate of acceptance, under the terms set forth therein.

 

BACKGROUND:

Oleg Vigdorchik and Viktoriya Vigdorchik (the “Grantor”) own Assessor’s Parcels 057-153-180 and 057-153-460 located at 647 Acacia Lane in Redwood City (the “Property”). On January 17, 2008 the Zoning Hearing Officer conditionally approved an application for subdivision of the Property. One of the conditions of approval, at the request of Cal-Fire, is the granting by Grantor of an easement to the County for use as an emergency vehicle turnaround and agreement by Grantor to construct and maintain the road improvements. Grantor desires to grant an easement to the County and the County is willing to accept an easement meeting the conditions of the Zoning Hearing Officer approval.

 

DISCUSSION:

Real Property Services has prepared an Agreement, Deed and Grant of Easement, which authorizes acceptance of an Emergency Fire Turnaround Easement from Grantor, and requires Grantor to construct and maintain the improvements within the easement at Grantor’s own cost and expense. The design and installation of the improvements must meet the standards of Cal-Fire and the Department of Public Works, and be maintained

by Grantor to the satisfaction of the County until, at the determination of the County, they are no longer required. Approval of this Agreement will satisfy a condition of the Zoning Hearing Officer’s approval, which may ultimately result in the subdivision of the Property.

 

County Counsel has reviewed and approved the Agreement and Resolution as to form. The Director of Public Works concurs in this recommendation.

 

Approval of the Agreement contributes to the Shared Vision 2025 outcome of a Healthy Community by supporting the outcome of safe neighborhoods by accepting an easement that will provide a safe turnaround for emergency vehicles.

 

FISCAL IMPACT:

There is no impact to the General Fund.
