BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING THE: 1) PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AGREEMENT, DEED AND GRANT OF EASEMENT WITH OLEG VIGDORCHIK AND VIKTORIYA VIGDORCHIK FOR AN EMERGENCY VEHICLE TURNAROUND EASEMENT LOCATED AT 647 ACACIA LANE IN REDWOOD CITY, ACCEPTING AN EASEMENT FOR AN EMERGENCY VEHICLE TURNAROUND AND THE INSTALLATION AND MAINTENANCE OF THE TURNAROUND AS A CONDITION OF APPROVAL FOR THE SUBDIVISION OF THE PROPERTY; AND 2) COUNTY MANAGER OR HIS DESIGNEE TO RECORD THE AGREEMENT AND EXECUTE AND ACCEPT ANY AND ALL NOTICES AND DOCUMENTS ASSOCIATED WITH THE AGREEMENT INCLUDING, BUT NOT LIMITED TO, A CERTIFICATE OF ACCEPTANCE, UNDER THE TERMS SET FORTH THEREIN.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, there has been presented to this Board for its consideration and acceptance an Agreement, Deed and Grant of Easement (the “Agreement”) dated July 12, 2011 between the COUNTY OF SAN MATEO, a political subdivision of the State of California (“County”), and OLEG VIGDORCHIK AND VIKTORIYA VIGDORCHIK, husband and wife as community property (“Grantor”); and

 

WHEREAS, Grantor owns Assessor’s Parcels 057-153-180 and 057-153-460 located at 647 Acacia Lane in Redwood City (the “Property”), and as a condition of approval of an application for subdivision of the Property, Grantor must grant to County an emergency vehicle turnaround easement and construct improvements; and

 

WHEREAS, Grantor desires to grant to the County an emergency vehicle turnaround easement over a portion of the Property and agrees to construct and maintain improvements to the satisfaction of the County, as set forth in the Agreement, to fulfill the conditions of the subdivision approval; and

 

WHEREAS, this Board has been presented with the Agreement and has examined and approved same as to both form and content and desires to enter into same.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board be, and is hereby, authorized and directed to execute said Agreement, Deed and Exchange of Easements for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest to the President’s signature thereto.

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to accept and record on behalf of the County, the Agreement and any and all notices, consents, approvals, terminations, deeds, certificates of acceptance, escrow instructions and documents in connection with the Agreement as needed to comply with the intent of this Resolution and the Board.
