BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION A) DECLARING CERTAIN COUNTY-OWNED UNIMPROVED REAL PROPERTY IN THE CITY OF HALF MOON BAY AS SURPLUS TO THE NEEDS OF THE COUNTY IN ORDER TO FACILITATE THE EXCHANGE OF THAT PROPERTY FOR PROPERTY OF EQUAL VALUE THAT IS REQUIRED FOR COUNTY USE, AND B) AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO EXECUTE AN AGREEMENT TO EXCHANGE REAL PROPERTY WITH PENINSULA OPEN SPACE TRUST AND THE CITY OF HALF MOON BAY; AND C) AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO ACCEPT OR EXECUTE ON BEHALF OF THE COUNTY, ANY AND ALL NOTICES, CERTIFICATES OF ACCEPTANCE, CONSENTS, APPROVALS, TERMINATIONS, DEEDS, ESCROW INSTRUCTIONS AND OTHER DOCUMENTS IN CONNECTION WITH THE AGREEMENT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, in the 1970’s certain unimproved properties on the Coastside within the incorporated limits of the City of Half Moon Bay were acquired by the County of San Mateo from private property owners or as a result of tax-default which Assessor’s Parcel Numbers are identified on Exhibit A, incorporated herein by this reference (the “County Real Property”); and

 

WHEREAS, this Board finds that the County Real Property is not required for County purposes and the property owned by the City of Half Moon Bay and identified as Assessor’s Parcel Number 056-210-360 (Arnold Way Property) is required for County use; and

 

WHEREAS, Section 25365 of the Government Code authorizes the Board, by a four-fifths vote, to exchange real property of equal value with any person, firm or corporation, where the property to be disposed is not required for County use and the property to be acquired is required for County use; and

WHEREAS, the Clerk of the Board of Supervisors has noticed the intended action of this Board of Supervisors pursuant to Section 6061 of the Government Code; and

 

WHEREAS, such notice of intent set the hearing for Tuesday, the 9th of August, 2011, at the hour of 9:30 A.M. in the Supervisors’ Chambers in the Hall of Justice and Records, 400 County Center, Redwood City, California; and

 

WHEREAS, this Board, as the lead agency, is required to comply with the California Environmental Quality Act (CEQA) and applicable State and County guidelines, finds that the impacts of the acquisition of the Property are di minimis, and categorically exempt under the California Environmental Quality Act (CEQA); and

 

WHEREAS, there has been presented to this Board for its consideration and acceptance an Agreement to Exchange Real Property (the “Agreement”) between the County as owner of the County Real Property, Peninsula Open Space Trust, a California non-profit public benefit agency, as owner of Assessor Parcel Numbers 065-011-040 and 065-011-050 (POST Property); and the City of Half Moon Bay as the owner of the Arnold Way Property, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved same as to form and content and desires to enter into same; and

 

WHEREAS, this Board finds the County Real Property, POST Property and Arnold Property to be of equal value.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED THAT:

    1. It is the opinion of this Board that the County Real Property is surplus to the needs of the County, and;

    2. The County Manager or his designee is hereby authorized and directed to execute the Agreement to Exchange Real Property for and on behalf of the County of San Mateo, and the Deputy Clerk of the Board will attest to the County Manager’s or his designee’s signature thereto; and

    3. The County Manager or his designee is hereby authorized to accept or execute on behalf of the County, any and all notices, certificates of acceptance, consents, approvals, terminations, deeds, escrow instructions and other documents in connection with the Agreement or to meet the intent of this Resolution and the Board.
