RESOLUTION AUTHORIZING 1) EXECUTION OF AN AGREEMENT WITH COASTSIDE SENIOR HOUSING LLP IN THE AMOUNT OF $3 MILLION FOR DEVELOPMENT OF AFFORDABLE SENIOR HOUSING, FOR THE TERM OF FOUR YEARS; AND 2) THE DIRECTOR OF THE DEPARTMENT OF HOUSING OR THE DIRECTOR'S DESIGNEE TO EXECUTE CONTRACT AMENDMENTS MODIFYING THE COUNTY'S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFYING THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, pursuant to Government Code, Section 31000, County may contract with independent contractors for the furnishing of special services to or for County or any Department thereof; and

 

WHEREAS, Mercy Housing California (“Project Sponsor”) applied for funding assistance for the development of Coastside Senior Housing (“Project”), a mixed-use development located at 925 Main Street, Half Moon Bay, California, which will consist of 40 units of affordable senior housing as well as ground floor program spaces for the Senior Coastsiders senior center and Coastside Adult Day Health Center; and

 

WHEREAS, Contractor and its development partner, Lesley Senior Communities, have formed a limited partnership, Coastside Senior Housing LP, to develop and own the improvements to be built on the Project site; and

 

WHEREAS, Senior Coastsiders and Coastside Adult Day Health Center, the current co-owners of the site, have executed an option with the LP granting the LP a 99-year ground lease of the land, and allowing the LP to build the complex and sublease the program spaces to Senior Coastsiders and Coastside Adult Day Health Center, and the option is being assigned by the LP to County; and

 

WHEREAS, over three fiscal years on May 5, 2009, April 27, 2010, and May 10, 2011, the Board of Supervisors approved CDBG, HOME, and ESG funding for various activities for respective Fiscal Years 2009-10, 2010-11, and 2011-12, and which included a total of $3 million funding ($677,170 CDBG and $2,335,830 HOME) for the Project; and

 

WHEREAS, LP (“Contractor”) and County wish to enter into an Agreement in the amount of $3 million for the development of Coastside Senior Housing, for the term of four years upon execution; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement between the County of San Mateo and Contractor, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

 

NOW, THEREFORE, IT IS HEREBY RESOLVED that the President of this Board of Supervisors be and is herby authorized and directed to execute said agreement: for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and the Director or the Director’s designee to execute contract amendments modifying the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modifying the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
