BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING 1)THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH EPA CANDO IN THE AMOUNT OF $130,000 FOR THE TERM OF THIRTY YEARS COMMENCING UPON THE DATE OF EXECUTION TO ACQUIRE REAL PROPERTY AT 2376 UNIVERSITY AVENUE, EAST PALO ALTO; AND 2)THE DIRECTOR OF THE DEPARTMENT OF HOUSING OR THE DIRECTOR’S DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, pursuant to Government Code, Section 31000, County may contract with independent contractors for the furnishing of special services to or for County or any Department thereof; and

 

WHEREAS, East Palo Alto Community Alliance and Neighborhood Development Organization (EPA CANDO) (“Contractor”) applied for funding assistance for acquisition of a single family home at 2376 University Avenue; and

 

    WHEREAS, Contractor’s ultimate goal is to assemble up to eight parcels in the immediate area of the subject property for redevelopment to a mixed use development comprising 32+ affordable family units plus commercial space; and

 

WHEREAS, on May 10, 2011, the Board of Supervisors approved the CDBG/ESG/HOME funding for FY 2011-12, which included $130,000 HOME funding for this purpose; and

 

WHEREAS, both parties now wish to enter into an Agreement in the amount of $130,000 for acquisition of 2376 University Avenue for the term of Thirty Years commencing upon the date of execution; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement between the County of San Mateo and Contractor, reference to which is hereby made for further particulars, and the Board of Supervisors has examined and approved the same as to form and content and desires to enter into the same.

 

NOW, THEREFORE, IT IS HEREBY RESOLVED that the President of this Board of Supervisors be and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

 

BE IT FURTHER RESOLVED, that the Director of the Department of Housing or the Director’s designee shall be authorized to execute contract amendments modifying the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modifying the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
