                  • FLSA recognizes three exemptions to the
                     weekly overtime pay requirement:

                        – Executive
                        – Administrative
                        – Professional

                  • Must satisfy two tests:

                        – Salary test
                        – Duties test

   Rulemaking

The salary test includes two major
components:

   1. Employee must be paid a predetermined
       salary of not less than $455.00 per week.

   2. Must be paid on a salary basis, which
       generally means that the wage is paid
       irrespective of the quantity or quality of
       work performed.
