                   Overtime Exemption Proposed
                   Rulemaking

                  The Department of Labor is openly
                  considering additional rule changes:

                            – The Federal Government is open-minded about adding
                               additional occupation examples to the duties test.

                            – The Federal Government is open-minded about adding
                               non-discretionary bonuses to satisfy at least part of the
                               weekly salary requirement for the three White Collar
                               exemptions.

                            – No specific changes have been identified and neither of
                               these subjects are addressed in the current rulemaking.

Rulemaking Process

   – The President of the United States directed
      the Department of Labor to start the
      rulemaking process on March 13, 2014.

   – The Department of Labor issued the
      proposed FLSA updates on July 6, 2015.

   – The Department of Labor closed the public
      comment period on September 4, 2015.

   – Final action to implement the salary test
      updates is expected in 2016.
